Cottage Food Law
Indiana Cottage Food Law (Indiana Code Section 16-42-5.2): Allows home-based food production and direct-to-consumer sale of non-potentially-hazardous foods without a state food handling license. Permitted products include baked goods (including those requiring refrigeration if sold immediately), jams, jellies, candy, dried herbs, and similar items. Annual gross revenue limit of $50,000 per year. Direct-to-consumer sales at farmers markets, farm stands, online (with in-person delivery), and from the home. Products must be labeled with: producer name and home address, product name, ingredient list in descending order, net weight, allergen statement, and 'Made in a Home Kitchen — Not Inspected by the Indiana State Department of Health.' No state permit or registration required. Indiana's cottage food law was significantly expanded in 2021 and again in 2023, raising the annual revenue cap to $50,000 and expanding the list of permitted products. Indiana is now considered one of the more permissive Midwestern states for cottage food operations.
