Replacement Parking Requirement

A replacement parking requirement is a local rule mandating that when a garage is converted to another use — typically a living space or accessory dwelling unit — the property owner must provide an equivalent number of new off-street parking spaces elsewhere on the lot. The requirement exists to prevent the net loss of off-street parking that would otherwise result from the conversion.

Land Use

In Practice

Whether replacement parking is required is frequently the deciding factor in garage conversion feasibility. Cities vary significantly on this point: some states have enacted laws that prohibit local governments from requiring replacement parking when a garage is converted to an ADU, while other cities and states still enforce the requirement. Where replacement parking is mandatory and the lot cannot accommodate new spaces, the conversion may not be feasible under current rules. Confirming your city's parking replacement policy before investing in design is essential.
