Tennessee Cottage Food Law (Tennessee Code Annotated Section 53-1-216): Allows home-based production of certain non-potentially-hazardous foods without a food establishment license. No annual revenue cap under state law. Allowed products include baked goods, jams, jellies, preserves, candy, dried herbs, and similar shelf-stable items. Direct-to-consumer sales permitted at farmers markets, roadside stands, and direct from home. Products must be labeled with producer name, address, and 'This product is homemade and is not inspected by the state or local health department.' Davidson County Health Department cannot impose additional registration requirements on cottage food operations within state law parameters. Tennessee has a relatively permissive cottage food framework with no revenue cap. Online sales with in-person pickup or delivery are generally permitted. Local health departments cannot require additional permits for operations within state law scope.
