Cottage Food Law
Pennsylvania Cottage Food Law (PA Act 2022-61): Allows home-based food businesses to produce and sell certain non-potentially-hazardous foods directly to consumers without a retail food facility license. Permitted products include baked goods (not cream or custard filled), jams, jellies, candy, dried herbs, dried pasta, and roasted nuts. Annual gross revenue limit of $35,000 per year. Direct-to-consumer sales only — no retail distribution. Farmers markets, farm stands, and online sales with in-person delivery are permitted. Products must be labeled with: business name, address, product name, ingredients in descending order by weight, net weight, allergen information, and 'Made in a Home Kitchen Not Inspected by the Pennsylvania Department of Agriculture.' Pennsylvania significantly expanded its cottage food law in 2022 through Act 61. Prior to 2022, PA had very limited cottage food provisions. The $35,000 cap and broad product list make it reasonably permissive for a Mid-Atlantic state.
