Cottage Food Law
Ohio Cottage Food Law (Ohio Revised Code Section 3715.021): Ohio allows home-based food production and direct sale of non-potentially-hazardous foods without a retail food establishment license. Permitted products include baked goods, jams, jellies, candy, dried herbs, popcorn, and similar shelf-stable items. Annual gross revenue limit of $35,000 per year. Direct-to-consumer sales from the home, at farmers markets, roadside stands, and community events. Online sales with in-person delivery are permitted. No retail distribution. Products must be labeled with: producer name and home address, product name, ingredient list in descending order, net weight, allergen statement, and 'Made in a Home Kitchen Not Inspected by the Ohio Department of Agriculture.' No state permit or registration required for operations under the $35,000 cap. Ohio's cottage food law has a $35,000 annual revenue cap, which is lower than neighboring states Indiana and Michigan. Ohio does not require registration for cottage food producers. Operations exceeding the cap require a Retail Food Establishment license from the Ohio Department of Agriculture.
