Cottage Food Law

New York Cottage Food Law (Agriculture and Markets Law Article 5-A, effective 2020): Allows home-based food businesses to sell directly to consumers without a state license. No annual revenue cap. Allowed products: non-potentially-hazardous foods including baked goods, jams, jellies, candy, dried pasta, granola, roasted nuts. Prohibited: products requiring refrigeration, meat, poultry, seafood. Sales permitted at farmers markets, roadside stands, fairs, from home. Labels must include producer name, address, food allergens, and 'Made in a home kitchen. This product was not made in a licensed food establishment.' New York expanded cottage food to include direct online sales with in-person delivery in 2021. NYC and other municipalities may have additional local requirements.
