Cottage Food Law

Maryland Cottage Food Law (Maryland Code, Health-General Article Section 21-322): Allows home-based production and direct sale of non-potentially-hazardous foods. Permitted products include baked goods, jams, jellies, candy, dried herbs, and similar items. Annual gross revenue limit of $25,000 per year. Sales may be direct to consumers at farmers markets, farm stands, and online (with in-person delivery). No retail or wholesale distribution. Products must be labeled with: producer name and address, product name, ingredients in descending order by weight, net weight, and 'Made in a home kitchen not inspected by the Maryland Department of Health.' No state license required but local health department notification may be required. Maryland's cottage food law was expanded in 2023 to include online sales with in-person delivery. Some Maryland counties impose additional cottage food regulations. Check with your local health department for county-specific requirements.
