Cottage Food Law

Kentucky Cottage Food Law (Kentucky Revised Statutes Section 217.215): Kentucky allows home-based production and direct sale of certain non-potentially-hazardous foods without a food establishment permit. Permitted products include baked goods, jams, jellies, candy, dried herbs, honey, and similar items. Annual gross revenue limit of $60,000 per year — one of the higher caps in the Southeast. Direct-to-consumer sales only — from the home, at farmers markets, roadside stands, community events, and online with in-person delivery. No retail distribution. Products must be labeled with: producer name and home address, product name, ingredient list in descending order, net weight, allergen statement, and 'Made in a Home Kitchen Not Inspected by the Kentucky Department for Public Health.' No state permit or registration required. Kentucky has increased its cottage food revenue cap in recent years, now one of the more permissive in the region at $60,000/year. Kentucky's cottage food law was updated in 2022 to include allergen labeling requirements consistent with federal standards.
