Cottage Food Law

Illinois Cottage Food Law (410 ILCS 625/3.5, PA 99-0531, effective 2016): Allows home-based food businesses to sell directly to consumers without a license. No annual revenue cap. Allowed products: non-potentially-hazardous foods including baked goods, candy, jams, jellies, dried mixes, spices. Sales must be direct-to-consumer (no retail, no internet sales). Labels must include producer name, address, and 'This food product was not produced in a licensed food manufacturing establishment and has not been inspected by the Illinois Department of Public Health.' Some county health departments have additional requirements. Illinois cottage food law does not allow mail-order or internet sales — sales must be direct to consumer. City of Chicago does not impose additional cottage food restrictions beyond state law.
