Cottage Food Law
Arkansas Cottage Food Law (Arkansas Code Annotated Section 20-57-601 et seq.): Allows home-based production and sale of certain non-potentially-hazardous foods without a food establishment permit. Permitted products include baked goods, jams, jellies, candy, dried herbs, popcorn, and similar items. Annual gross revenue limit of $50,000 per year. Direct-to-consumer sales only — at the home, farmers markets, farm stands, and community events. No retail or wholesale distribution. Online sales with in-person delivery may be permitted. Products must be labeled with: producer name and address, product name, ingredients in descending order, net weight, allergen information, and 'Made in a Home Kitchen Not Inspected by the Arkansas Department of Health.' No state permit required. Arkansas has a relatively generous $50,000 annual revenue cap for cottage food operations. The 2023 update to Arkansas cottage food law expanded permitted products and increased the revenue cap. No registration or permit is required to begin cottage food operations.
