Zoning Glossary

Home-Based Daycare

Home-based daycare is the operation of a child care business from a residential property, governed by both zoning regulations and state child care licensing requirements. These operations are typically classified under state and local law into two categories: smaller family daycare homes, which serve a limited number of children and may be permitted by-right in residential zones, and larger group daycare homes, which serve more children and may require additional zoning approvals such as a conditional use permit.

Land Use

In Practice

The number of children served determines which regulatory category applies and what approvals are required. Many states have enacted protections that classify small licensed family daycare homes as residential uses, preventing cities from prohibiting them in residential zones or imposing more restrictive conditions than those applied to other single-family uses. Operators must navigate two separate regulatory tracks — zoning approval and state licensing — which are independent requirements that both must be satisfied before opening.
