Cottage Food Permit

A cottage food permit is a registration, license, or formal certification that some states and localities require producers to obtain before making or selling homemade food products from a residential kitchen. Permit and registration requirements vary widely across the country — some states require no registration whatsoever, others require registration with a state agriculture or health agency, and some jurisdictions impose additional local health department requirements on top of state requirements.

Land Use

In Practice

Where a cottage food permit or registration is required, the process is generally simpler and less costly than obtaining a commercial food facility license — the intent is to create an accessible pathway for small home-based food producers. Even in states that impose no permit requirement, proper product labeling is universally required: all state cottage food laws mandate labels that identify the product's home kitchen origin. Checking your specific state's requirements before beginning sales avoids compliance issues.
